NEW YORK’S PAID PRENATAL LEAVE LAW

New York has taken a significant step in supporting pregnant workers by enacting the nation’s first Paid Prenatal Leave Law. Starting January 1, 2025, employers are required to provide 20 hours of paid leave annually for pregnancy-related medical appointments. This groundbreaking legislation recognizes the importance of prenatal care and aims to ensure that pregnant employees can access necessary medical services without sacrificing their pay.

This new law requires employers to take the following steps:

  1. Develop a clear, written policy outlining the details of the paid prenatal leave program, including eligibility requirements, how employees can request leave and any necessary documentation to provide in connection with a request.
  2. Communicate this policy effectively to all employees.
  3. Update your leave tracking systems to properly manage and record this new type of leave.
  4. Consult with legal counsel to ensure your policy and procedures are fully compliant with the new law.

Penalties: Failure to meet these requirements may result in liability for unpaid overtime, including back pay, liquidated damages and potential legal action.
